Navigating the UK Budget: Exploring Gibraltar Residency

04 Nov 2024

On 30 October 2024, Chancellor Rachel Reeves delivered the first Budget of the new Labour Government, introducing significant tax reforms impacting UK businesses and individuals. These measures, aimed at raising £40 billion in additional revenue, have prompted many to consider alternative jurisdictions with more favourable tax regimes. Gibraltar, with its attractive tax policies and strategic location, emerges as a compelling option for both businesses and individuals seeking residency.

Key Measures Announced in the UK Budget

Increase in Employer National Insurance Contributions (NICs)

From April 2025, employers' NICs will rise from 13.8% to 15%, and the threshold at which these contributions become payable will decrease from £9,100 to £5,000. While the employment allowance will increase from £5,000 to £10,500 per year, this change is expected to raise £25 billion annually, imposing additional costs on employers.

Abolition of the Non-Domiciled (Non-Dom) Tax Regime

The Budget announced the non-dom tax regime's abolition, effective April 2025. This change will subject individuals previously benefiting from this status to UK taxation on their worldwide income and gains, potentially leading to higher tax liabilities.

Increase in Capital Gains Tax (CGT)

The Budget introduces a significant increase in CGT rates, with the basic rate rising from 10% to 18% and the higher rate from 20% to 24%. This change affects individuals disposing of assets such as shares, property, and other investments, resulting in higher tax liabilities on gains.

Changes to Inheritance Tax (IHT)

The Budget caps IHT relief on agricultural and business property at £1 million, limiting the previously available 100% relief. This measure increases the IHT burden on estates, particularly those with significant agricultural or business assets.

Increase in Stamp Duty for Second Homes

Stamp duty on second homes will rise by two percentage points, from 3% to 5%, effective immediately. This measure aims to reduce demand for second homes and make properties more accessible for first-time buyers.

Understanding Gibraltar's Residency Options

In light of these substantial tax increases, Gibraltar presents an attractive alternative for both businesses and individuals seeking a more favourable tax environment. As a British Overseas Territory, Gibraltar offers a stable political climate, a robust legal system, and a strategic location at the crossroads of Europe and Africa.

Gibraltar Tax Regime

No Capital Gains Tax, Inheritance Tax, or Wealth Tax

Gibraltar does not impose capital gains tax, inheritance tax, or wealth tax, allowing individuals to preserve and grow their wealth without the burden of these taxes.

Lower Income Tax Rates

Gibraltar offers competitive income tax rates, with a maximum rate of 25% under the Gross Income Based System. Additionally, high-net-worth individuals can benefit from the Category 2 (Cat 2) residency status, which caps tax on worldwide income to the first £118,000 of assessable income, resulting in a maximum tax liability of approximately £37,000 per annum.

Competitive Corporate Tax Rate

The corporate tax rate in Gibraltar is set at 15%, significantly lower than the UK's 25% rate, providing substantial savings for businesses.

Navigating Tax Changes with Gibraltar Residency Options

Category 2 (Cat 2) Residency

Designed for high-net-worth individuals, Cat 2 residency offers a capped tax liability on worldwide income, with a minimum tax payable of £22,000 and a maximum of approximately £37,000 per annum. Applicants must have a minimum net worth of £2 million and approved residential accommodation in Gibraltar.

High Executive Possessing Specialist Skills (HEPSS) Residency

Aimed at attracting skilled professionals, the HEPSS scheme allows individuals earning more than £160,000 annually to benefit from a capped tax liability on the first £160,000 of income, resulting in a maximum tax payable of approximately £39,000 per annum. Applicants must possess skills not readily available in Gibraltar and hold a contract of employment with a Gibraltar-registered company.

Benefits of Relocating to Gibraltar

- Stable and Transparent Legal System: As a British Overseas Territory, Gibraltar follows English common law, providing a familiar and reliable legal framework for businesses and individuals.

- Strategic Location: Situated at the southern tip of the Iberian Peninsula, Gibraltar offers easy access to European and African markets, making it an ideal base for international business operations.

- High Quality of Life: With a Mediterranean climate, high standard of living, and a vibrant cultural scene, Gibraltar provides an excellent environment for both work and leisure.

The recent UK Budget introduced significant tax increases that impact businesses and individuals. In contrast, Gibraltar offers a more favourable tax environment with attractive residency options, making it a compelling alternative for those seeking to optimise their position while enjoying a high quality of life. Businesses and individuals can benefit from a stable jurisdiction with a favourable tax regime, strategic location, and excellent living conditions by considering relocation to Gibraltar.
